Is it normal to only get half of your 13th month pay in your first year

Nag-start ako ng trabaho last May as a merchandiser, tapos ngayong December binigay lang nila sa akin around P8,000 na 13th month kahit P18,000 ang monthly ko. Sabi ng HR pro-rated daw. Legal ba ito o niloloko ako?

Legal yan, hindi ka niloloko. Under PD 851, 13th month is computed as your total basic salary earned within the year divided by 12, so kung May ka nag-start, wala ka pang buong 12 months of earnings. From May to December that's roughly 8 months, so 8 x P18,000 = P144,000 divided by 12 = P12,000 gross, but if may absences ka na walang pay or late ka sa cutoff, bababa pa yan. Ask HR for the exact computation breakdown, they are legally required to show it to you.
